Abstract

The land is a Natural Resource that from the past until now will never be separated from human life. The land will always be related to human life and has a strategic value for human life because the land is used to build a place to live and fulfill life needs that can provide prosperity and welfare for the community. Although land has an important role in human life, it cannot be denied that land can also be one of the main factors in the emergence of problems in human life. So important is the land that it is necessary to have a land certificate as a strong legal basis so that no land use often causes land disputes. Land certificates are also the strongest evidence for proving land rights. As time goes by and technological developments, to serve the community quickly and precisely the Ministry of Land and Spatial Planning / National Land Agency (ATR / BPN) will implement or replace analog certificates with electronic certificates which are expected to advance the community and create positive public opinion on land services. In the future, land certificates will no longer be in the form of paper or books but electronic. In this writing, there is also a formulation of the problem, namely how the legal certainty of land rights holders against holders of electronic land certificates and how the regulation of electronic land certificate holders through Ministerial Regulations. The author uses a Normative Juridical approach as his research method in this writing. Based on the author's analysis, the land rights will have strong legal certainty by first registering these rights at the National Land Agency office so that these rights are guaranteed to have authentic deeds. Regus regulatedUUPA Article 19 Paragraph 2 Letter C and the statement of UUPA Articles 23, 32, and 38, it can be understood that regarding the registration of land rights, the legal consequences are that the owner of the land rights gets a land title certificate and as strong evidence of ownership of land rights. and Electronic land registration leads to the issuance of proof of ownership of land rights in electronic form as well. The government understands that there are imperfections in the Ministerial Regulation on e-certificates, because of the legal source it uses. Government Regulation No. 18 of 2021 on Management Rights, Land Rights, Flat Units, and Land Registration. The following is based on the consideration of the Ministerial Regulation which refers to the UUPA and its implementing regulations, as well as the regulations governing the ITE Law and the Job Creation Law.
