Abstract
Regarding persecution in article 351 of the Criminal Law Code is defined as deliberately causing bad feelings, suffering, injury or pain. Persecution occurred because of internal and external problems that gave rise to the incident. Internal factors, for example, the age of the perpetrators who are still relatively young, lack of education, and different cultures. While external factors are due to pressure from the attitude of the victim and the attitude of the perpetrator, the encouragement of people around, and the time and place of emotional friction. Therefore a forced defense emerged that exceeded the limits (noodweer exces) stipulated in Article 49 paragraph (2) of the Criminal Law Code. In general, forced defense is an attitude of protecting oneself and others from attack. If you receive an attack, for example, you will be killed or beaten, then in order to protect yourself or others, it is permissible to fight back even though in law it is prohibited. Determine the responsibility of a person for what he has done in carrying out forced defense that exceeds the limit, carried out by reviewing the state of mind or soul of a person. Defense that exceeds the limit due to severe mental turmoil is indeed considered against the law, but is not subject to punishment, because the shaken soul or mind is the reason for the defendant's guilt to be erased. But the abolition or abolition of punishment is only the judge who can determine through regulations that stipulate the conditions for the offender to fulfill the offense that should be punished, but not convicted.
