Abstract

This thesis is the result of research that aims to know and explain the regulation of Artificial Intelligence (AI) technology and the position of AI technology in the criminal justice system in Indonesia. AI technology is defined as artificial intelligence that is believed to be able to facilitate work that is generally done by humans. As for the background of the author's interest in making this thesis, that is, along with the development of technology, it will certainly bring changes in life that can occur due to various innovations and the latest works from humans, for example with the emergence of AI technology or what we usually call Artificial Intelligence. This technology can act and think about things like a human being in the view of law, of course, this will bring considerable changes. However, with the significant advancement of technology, in Indonesia this is underutilized, especially in the criminal justice system which in administrative terms still uses manual methods. In compiling this research, the author uses normative legal research methods (doctrinal research) in which using laws and regulations, accompanied by the method of approaching laws and using conceptual approach methods. The results of this study show that there is a match or conformity to the regulations that explain the position of AI technology, namely in Article 1 Number 5 ITE Law which explains that AI is an electronic system that can collect, process, analyze, display, and send electronic data. In addition, if there is a leak, the person responsible is the electronic agent as explained in Article 1 Number 8 of the ITE Law. In its use in the criminal justice system, AI can provide time efficiency in administrative fields such as Clerks and Secretaries, but it does not rule out the possibility that AI can also help judges in helping analyze decision making.
