Abstract

In the provisions of criminal procedural law, proving is a central point in examining cases in court. This is because it is through this stage of proof that a process, method and deed proves to show the right or wrong of the defendant in a criminal case in court. Regarding the evidence that can be used by judges to determine whether someone is guilty or not, it has been regulated in Article 184 of the Criminal Procedure Code which includes: Witness statements, expert statements, letters, instructions, and statements of the accused. Along with technological developments, electronic evidence becomes part of legal evidence when referring to a special law. Electronic evidence is part of the guiding evidence contained in Article 188 paragraph (2) of the Criminal Procedure Code, which means that electronic evidence is not independent evidence as the five pieces of evidence mentioned in Article 184 of the Criminal Procedure Code, but after the decision of the Constitutional Court Number 20/ PUU-XIV/2016 then "Inparticular Electronic Information and/or electronic documents as evidence are carried out in the context of law enforcement at the request of the police, prosecutors and/or other law enforcement agencies. In future criminal cases, all electronic documents/electronic information in criminal law enforcement cannot be used as evidence/instructions if they do not meet the requirements decided by the Constitutional Court.
