Abstract

Di balik argumentasi penjatuhan sanksi kebiri kimia terhadap pelaku tindak pidana pedofilia, yang tergolong kejahatan berat karena jumlah korban yang tinggi dan menimbulkan trauma psikologis dan kerugian bagi anak yang masih memiliki masa depan. Oleh karena itu, pemerintah Indonesia menanggapi masalah ini dengan serius dan memberlakukan Undang-Undang Nomor 17 Tahun 2016, yang memberikan hukuman tambahan bagi pelaku pedofilia berupa kebiri kimia. Hukuman tambahan ini menjadi penyebab kepedulian negara terhadap anak bangsa dan generasi yang akan datang. Akan tetapi, hal ini menimbulkan dilema bagi dokter yang memiliki profesi dan pengalaman sendiri di bidang medis, yang dimana disinilah dokter yang ditunjuk untuk menjadi tim eksekutor dalam membantu jaksa dalam eksekusi kebiri kimia terhadap pelaku kejahatan. Ketua atau Presiden Ikatan Dokter Indonesia (IDI) mengatakan akan menolak penggunaan dokter sebagai penegak sanksi kebiri kimia. Keterlibatan profesi kedokteran dalam proses pemidanaan melalui kebiri kimia bertentangan dengan Kode Etik atau (Sumpah) dan Undang-Undang Nomor 29 Tahun Praktik Kedokteran 2004 yang mereka jadikan pedoman dalam menjalankan segala tugasnya. Penulis menitikberatkan pada kedudukan hukum seorang dokter yang menolak kebiri kimia. Dalam penulisan ini menggunakan metode penelitian pendekatan undang-undang (Statue Approachd) dan pendekatan konseptual (Conceptual Approach). Karena Kode Etik bukan undang-undang, maka Kode Etik bukanlah tindakan legislatif, melainkan aturan dalam kedokteran yang biasanya hanya diterima oleh golongan tertentu jika ditetapkan oleh Ikatan Dokter Indonesia (IDI). Maka dokter harus mematuhi perintah undang-undang untuk melaksanakan tugasnya sebagai tim pembantu jaksa menjadi eksekutor kebiri kimia karena secara hierarki undang-undanglah sebagai kedudukan tertinggi dan ini juga sudah perintah negara.
