Abstract

Kejaksaan Agung RI adalah lembaga kejaksaan yang berkedudukan di Ibu Kota Negara Republik Indonesia, yang bertanggung jawab secara langsung di bawah Presiden dan wilayah hukumnya meliputi wilayah kekuasaan Negara Republik Indonesia. Kejaksaan Republik Indonesia adalah lembaga negara yang melaksanakan kekuasaan negara, khususnya di bidang penuntutan. Sebagai badan yang memiliki wewenang dalam penegakan hukum dan keadilan, Kejaksaan dipimpin oleh Jaksa Agung yang dipilih oleh dan bertanggung jawab kepada Presiden. Kejaksaan sebagai salah satu lembaga negara dalam penegak hukum yang dituntut untuk lebih berperan dalam menegakkan supremasi hukum, perlindungan kepentingan umum, penegakan hak asasi manusia, serta pemberantasan korupsi (penyalahgunaan keuangan negara dan/atau rakyat), kolusi (kerja sama rahasia untuk maksud tidak terpuji), dan napotisme (kecenderungan untuk mengutamakan sanak saudara sendiri terutama dalam jabatan di lingkungan pemerintahan). Keadilan Restoratif atau Restorative Justice adalah salah satu prinsip penegakan hukum dalam penyelesaian perkara yang dapat dijadikan instrumen pemulihan dan sudah dilaksanakan oleh Mahkamah Agung dalam bentuk pemberlakuan kebijakan (Peraturan Mahkamah Agung dan Surat Edaran Mahkamah Agung), namun pelaksanaannya dalam sistem peradilan pidana di Indonesia masih belum optimal. Keadilan restoratif atau restorative justice merupakan alternatife penyelesaian perkara tindak pidana yang dalam mekanisme tata cara peradilan pidana berfokus pada pemidanaan yang diubah menjadi proses dialog dan/atau mediasi yang melibatkan pelaku dan korban untuk menciptkan kesepakatan atas penyelesaian perkara pidana yang adil dan seimbang bagi pihak korban maupun pelaku. Menurut perspektif hukum, korupsi adalah perbuatan melawan hukum dengan maksud memperkaya diri sendiri dan atau orang lain, baik perorangan maupun korporasi yang dapat merugikan keuangan negara, penyuapan, pemerasan, penggelapan dalam jabatan, perbuatan curang, benturan kepentingan dalam pengadaan, gratifikasi.
