Abstract

Tidak ada penanganan dalam kasus tindak pidana kekerasan seksual atau kejahatan seksual merupakan kesalaha pemerintah yang dapat melanggar Hak Asasi Manusia, karena pada dasarnya negara adalah membuat peraturan untuk mencegah terjadinya suatu tindak pidana yang dapat merugikan rakyatnya. Kekerasan seksual atau kejahatan seksual secara stastistik memang masih menyasar pada perempuan, hal ini karena terjadinya suatu perbedan relasi yang mana pada umumnya perempuan dianggap yang paling rendah sehingga korban kejahatan seksual atau kekerasan seksual masih dominan dilakukan kepada perempuan. Rendahnya pelaporan terhadap kasus kekerasan seksual juga masih pasif karena, takut akan masyarakat sekitarnya bukan membantu korban, namun memberikan dampak negatif seperti mengucilkan, atau mendeskriminasikan korban sehingga korban menjadi tereksplotasi oleh masyarakat. Faktor penghambat lain adalah pelaporan, minimnya alat bukti yang dimiliki, kebanyakan korban lebih banyak menceritakan kekerasan yang dilakukan kepadanya kepada seseorang, sehingga dalam pelaporan, korban hanya mengajak teman atau seseorang untuk menjadi saksi. hal ini juga menjadi sulit mengingat ada asas unus testis nullus testis yang memiliki makna bahwa satu saksi ini bukanlah saksi, karena keterangan saksi tidak bisa meyakinkan hakim dalam menjatuhkan keputusan kepada pelaku kekerasan seksual atau kejahatan seksual jika tidak dilengkapi oleh alat bukti lainnya. Hal ini melatar belakangi bagaimana sifat asas unus testis nullus testis dan bagaimana kedudukan asas unus testis nullus testis dalam pembuktian tindak pidana kekerasan seksual. Metode penelitian menggunakan jenis penelitian hukum normatif dengan metode pendekatan perundang-undangan dan pendekatan konsep, yang menghasilkan sifat asas unus testis nullus testis serta kedudukan asas unus testis nullus testis dalam pembuktian tindak pidana kekerasan seksual.
