Abstract

This thesis aims to find out Indonesian migrant workers who are victims of human trafficking are very vulnerable to a very large population that chooses an unequal number of men and women, with an economic crisis that is low enough to produce very clear jobs. Nearly 50 percent of Indonesian workers abroad are victims of human trafficking. Knowing how the law protects migrant workers who are victims of trafficking in persons and how the government's role in law enforcement counteracts the crime of trafficking in persons. This legal writing is a type of normative legal research that is perscriptive in nature by using a statutory approach (statute approach) and a conceptual approach (conceptual approach). The sources of legal materials used are primary, secondary and tertiary legal materials. The data collection technique used was literature study or data collection using interviews and library research, or existing legal journal sites, then the analysis technique used was the normative perscriptim method. The results of the research and discussion that the authors conducted concluded that Law no. 18 of 2017 concerning the Protection of Indonesian Migrant Workers in Article 5 as overseas migrant workers which states the age requirement for working abroad is 18 (eighteen) years old. Migrant workers are very vulnerable to violence or trafficking in persons so they are not allowed to become migrant workers abroad, because it endangers the workers' high risk and safety. Legal protection for Indonesian migrant workers perpetrated by victims of trafficking in persons (Human trafficking) is regulated in Article 297 of the Criminal Code, however, because Human Trafficking in persons has developed into an organized transnational crime, in Law no. 21 of 2007 concerning the Eradication of the Crime of Trafficking in Persons which is regulated in Article 1 point 1 which in essence is significant for victims of trafficking in persons every year criminal acts increase.
