Abstract

Pada prinsipnya Negara adalah Negara yang berdasarkan hukum dan UUD NEGARA 1945 yang merupakan konstitusi adalah peraturan perundang-undangan tertinggi. sebagaimana ditegaskan dalam Undang-Undang Nomor 12 tahun 2011 tentang Pembentukan Peraturan PerUndang-Undangan. Sebagai norma tertinggi tentu semua peraturan perundang-undangan harus sesuai dengan UUD NEGARA 1945 (tidak boleh bertentangan). Keberadaan Peraturan Menteri Hukum dan Hak Asasi manusia Nomor 02 Tahun 2019 Tentang Penyelesaian konflik norma melalui mediasi. Dalam UUD NEGARA 1945 hanya mengatur jalur litigasi berupa uji materi ke Mahkamah Agung terhadap peraturan perundang-undangan dibawah Undang-Undang yang bertentangan dengan Undang-undang.Konstusionalitas Permenkumham tersebut menarik untuk dikaji apakah materi muatannya yang memberi ruang mediasi dalam penyelesaian disharmoni peraturan Perundang-undangan tersebut bertentangan dengan UUD NEGARA 1945 ataukah sudah sesuai dengan konstitusi. Penelitian ini bertujuan untuk mengetahui apakah keberadaan Permenkumham Nomor 02 Tahun 2019 sudah sesuai dengan UUD NEGARA 1945 dan untuk mengetahui kekuatan hukum hasil mediasi yang berupa kesepakatan. Penelitian ini mengetengahkan metode pada penelitian hukum yuridis normatif dengan pendekatan peraturan perundang-undangan , pendekatan konseptual . Pada subtansi pembahasan diuraikan bahwa pada prinsipnya Permenkumham Nomor 02 Tahun 2019 bertentangan dengan UUD NEGARA 1945. Karena Permenkumham tersebut tidak diatur /bukan amanat konstitusi. Penyelesaian disharmonisasi juga dapat dilakukan dengan pendekatan pada asas-asas hukum seperti: Asas lex posteriori derogate legi priori, asas lex special derogate lex generalis dan asas lex superiori derogat legi inferiori. Sementara pada pembahasan rumusan kedua diuraikan bahwa pada prinsipnya hasil mediasi yang berupa kesepakatan para pihak tidak mempunyai kekuatan hukum yang mengikat dan memaksa.
