Abstract

Marriage is a social pattern in which a man and a woman bind themselves as husband and wife. From an Islamic perspective, mitsaqon ghalizhan is a very strong contract that requires worship under certain conditions and obedience to Allah's commands. This research focuses on the problem of child marriage in terms of Law Number 16 of 2019 concerning improvements to Law Number 1 of 1974 concerning Marriage. This research is a normative law research with statutory approach and concept approach. The results of this study indicate that when viewed from the perspective of marriage law in Indonesia, child marriage based on the previous marriage law provides for tolerance regarding underage marriages, by providing an age limit at the age of 16 in allowing marriage. Of course in this case, the disparity in legal provisions relating to child marriage issues requires efforts to harmonize the various marriage law systems in Indonesia to reduce legislative obstacles since now, namely revising the marriage law and carrying out maturing age in marriage so that these efforts can minimize the possibility of prevent child marriage from occurring. The role of the government is very much needed in this regard and is committed to stopping the practice of underage marriage traditions because in addition to the urgency that is not urgent, it will actually add new problems in the development of society such as affecting women's and children's health problems, divorce which will increase due to household problems that based on emotions that are still unstable, as well as the safety of the mother and child when they are about to give birth.
