Abstract

Merek merupakan suatu hal penting yang dimiliki oleh pelaku usaha dan tidak jarang dikatakan sebagai asset dari suatu bisnis. Untuk itu, merek adalah suatu hak atas kekayaan intelektual yang semestinya mendapat perlindungan oleh negara. Peraturan mengenai merek di Indonesia sendiri tertuang pada Undang-Undang Nomor 8 Tahun 1999 mengenai Perlindungan Konsumen serta Undang-Undang No. 20 Tahun 2016 mengenai Merek serta Indikasi Geografis. Akan tetapi, meskipun telah dilindungi, berbagai perlindungan merek masih terjadi dan kebanyakan dilakukan oleh pelaku usaha. Atas dasar tersebut, penelitian ini akan mencoba menganalisis bagaimana akibat hukum serta pertanggungjawaban pelaku usaha yang melakukan pelanggaran ha katas merek. Perlindungan hukum adalah segala upaya pemenuhan hak dan pemberian bantuan untuk memberikan rasa aman kepada saksi dan atau korban, yang dapat diwujudkan dalam bentuk seperti melalui restitusi, kompensasi, pelayanan medis, dan bantuan hukum. Metode yang diterapkan di riset ini yaitu metode penelitian normative dan pendekatan penelitian berupa penelitian kualitatif. Adapun hasil pembahasan dalam penelitian menunjukkan bahwa akibat hukum dari pelanggaran hak atas merek, pelaku usaha dapat dituntut dalam persidangan oleh pemilik merek asli, tidak hanya melalui perdata namun juga pidana. Adapun pertanggungjawaban pihak yang melaksanakan pelanggaran hak atas merek diatur pada Undang-Undang Merek dimana pelakunya dapat dikenai sanksi penjara maupun saksi ganti rugi.
