Abstract

The ease of accessing telemedicine health services is the main attraction where people do not need to spend more time, effort, or even money to get health services. Basically the practice of telemedicine health services in Indonesia still refers to the Law of the Republic of Indonesia Number 29 of 2004 concerning Medical Practice and the Law of the Republic of Indonesia Number 36 of 2009 concerning Health, because Indonesia still does not have laws and regulations that regulate explicitly regarding telemedicine health services, where telemedicine health service arrangements in Indonesia are only contained in the Regulation of the Minister of Health of the Republic of Indonesia Number 20 of 2019 concerning the Implementation of Telemedicine Services Between Health Service Facilities. Because there are no laws and regulations that explicitly regulate telemedicine health services in Indonesia, a conclusion is found which raises a problem that questions the legal basis for the practice of administering and supervising telemedicine health services in Indonesia, which are predominantly managed by providers of online clinical applications. As well as questioning how legal protection is for telemedicine patients in the event of an error caused by a doctor, and also how the responsibility of online clinical applications as providers of telemedicine health service platforms is. The juridical-normative method is used in this study and is supported by a statutory approach as well as a conceptual approach, which will later provide a juridical analysis of telemedicine practice in Indonesia and also an analysis of the forms of protection for telemedicine patients.
