Abstract

Indonesia negara yang banyak jumlah kasus korupsi, oleh sebab itu pemberantasan korupsi harus dilakukan dengan berbagai upaya baik pencegahan maupun penindakan. Pengorganisasian masyarakat, advokasi, maupun sosialisasi kebijakan anti korupsi merupakan hal yang tidak dapat dilepaskan dari upaya tersebut, termasuk dalam penegakan hukum. Lembaga peradilan menjadi salah satu ujung tombak dalam pemberantasan korupsi, terutama dalam upaya penjeraan koruptor. Salah satu bentuk landasan kebijakan yang kuat dari pemerintah Indonesia adalah terbentuknya UU No.20/2001 tentang perubahan atas UU No.31/1999 tentang Pemberantasan Tindak Pidana Korupsi sebagai pengganti UU No.3/1971. Sejak diundangkan Perma No.1/2020 Tentang Pedoman Pemidanaan Pasal 2 Dan Pasal 3 Undang - Undang Pemberantasan Tindak Pidana Korupsi tidak memberikan dukungan yang signifikan dalam memberantas praktik korupsi sehingga dalam hal ini Perma No.1/2020 akan di kaji dengan Rumusan Masalah sebagai berikut: Permasalahan yang pertama 1. Bagaimana Kedudukan Perma Nomor 1 Tahun 2020 Dalam Pemberantasan Tindak Pidana Korupsi ? dan permasalahan yang ke 2. Bagaimana Pedoman Pemidanaan Perma Nomor 1 Tahun 2020 Terhadap Pelaku Tindak Pidana Korupsi Berdasarkan Nilai Keadilan ? Penelitian ini menggunakan penelitian Normatif, yaitu dengan menggunakan metode Pendekatan perundang-undangan (statute approach), Pendekatan konseptual (conceptual approach), dan Pendekatan kasus (case approach). Sedangkan bahan hukum yang digunakan ialah bahan hukum primer, sekunder, dan tersier. Implementasi Perma No.1/2020 bersifat fakultatif yang artinya tidak ada kewajiban bagi hakim dalam menerapkan Perma No.1/2020 terhadap kasus tindak pidana korupsi, terlepas dari perma ini dibentuk untuk menghindari disparitas perkara yang memiliki karakter serupa untuk penjatuhan pidana yang proporsional serta mewujudkan keadilan berdasarkan Pancasila dalam perma ini jelas tidak sesuai dengan ekspektasi keadilan dan supremasi hukum yang dicitakan.
