Abstract

Penyelenggaraan pemilihan umum harus dilaksanakan secara lebih berkualitas daei waktu ke waktu, karenanya pemilu merupakan unsur demokrasi yang menjadi bentuk konkret keterlibatan rakyat dan akan kedaulatannya memilih atau dipilih sebagai seorang perwakilan legislative maupun pemimpin di eksekutif. Parliamentary Threshold & Presidential Threshold merupakan mekanisme dalam pesta demokrasi di Indonesia yang dalam hal ini memiliki perdebatan pada indeks demokrasi yang dipertanyakan dengan isu yang diambil dalam penelitian ini, Parliamentary Threshold & Presidential Threshold dengan konsep Demokrasi dan Putusan MK No 48/PUU-XIX/2021 bentuk Pelanggaran HAM berdasarkan Pasal 43 Undang-Undang Nomor 30/1999 tentang Hak Asasi Manusia Adapun pendekatan masalah untuk menjawab isu hukum tersebut adalah Pendekatan perundang-undangan (statue approach), adalah pendekatan dengan menggunakan legislasi dan regulasi. Pendekatan konseptual (conceptual approach) digunakan untuk mengkaji dan menganalisis kerangka pikir, kerangkan konsep atau landasan teoritis legal issue yang akan diteliti, dari pendekatan ini peneliti dapat menggunakan pisau analisis dalam mencari jawaban atas isu hukum dari penulisan skripsi ini. Berdasarkan analisis bahan hukum yang dilakukan, diperoleh simpulan bahwa Batas Parlemen Parliamentary Threshold & Presidential Threshold di Indonesia yang sebagai muatan demokrasi atas partispasi masyarakat dalam proses pemilihan umum untuk ikut menentukan perwakilan dan arah kepemimpinan pemerintahan yang berkualitas.
