Abstract
PP No.24/2022 makes bank financial institutions and non-bank financial institutions based on intellectual property as debt guarantee objects. The creative economy that can be used as material collateral consists of fiduciary guarantees on intellectual property, contracts in creative economic activities, and billing rights in creative economic activities. Article 7 stipulatesthat intellectual propertybased financing is submitted by creative economy actors to bank financial institutions or non-bank financial institutions and has requirements for submitting intellectual property-based financing consisting of at least a financingproposal, owning a creative economy business, having an agreement related to intellectual property of creative economy products, have an agreement related to the intellectual property of creative economy products, and have a registration letter or certificate of intellectual property. In carrying out the execution of the fiduciary guarantee certificate it must be carried out and apply the same as the implementation of an execution that has permanent legal force. With regard to the provisions for executing fiduciary guarantees regulated in Article 15 in conjunction with Article 29 of Law No.42/1999 makingit easy for creditorsto settle their credit, they don't have to file a lawsuitin a district court, but creditors can seek mediation and can also execute by mediation if there is no way. go out. In addition, it is emphasized in Article 8 PP No/24/2022 that bank financial institutionsor non-bank financial institutions in providing intellectual propertybased financing have registered their intellectual property rights and there must be verification of creative economic businesses and implementation of execution based on the provisions of Article 29 LawNo.42/1999, which requiresthe fiduciary giver (debtor) to be in a stateof default. Therefore, bank or non-bank financial institutions are currently expected to provide clarity on what items can be guaranteedto bank or non-bank financial institutions regarding guaranteeing YouTube content, because YouTube content is different from other objects where there is a higher risk for creditors. for the content to be guaranteed.
