Abstract

Pasca di tetapkanya Peraturan Pemerintah (PP) Nomor 21 Tahun 2020 tentang Pembatasan Sosial Berskala Besar dalam Rangka Percepatan Penanganan Corona Virus Disease 2019 yang berakibat pada pembatasan sosial sebagai solusi untuk mencegah penyebaran covid 19, berdampak pada penyampain pendapat di muka umum yang di batasi, maka perlu dalam analisa hukum , keadaan darurat yang membatasi hak berpendapat di muka umum, penelitian ini yang bertujuan untuk mengetahui ketepatan tindakan pemerintah dalam keadaan pandemi terhadap kebebasan berpendapat dengan menelaah isu soal pembatasan penyampaian pendapat di muka umum disaat pandemi dalam perspektif HAM dan bentuk perlindungan hukum terhadap penyampaian pendapat dimuka umum disaat pandemi. Dengan menggunakan metode pendekatan perundang - undangan (statute approach) merupakan penelitian yang mengutamakan bahan hukum yang berupa peraturan perundang-undangan sebagai bahan acuan dasar dalam melakukan penelitian sebagai isntrumen dalam menjawab penelitian ini dan metode Pendekatan konseptual (conceptual approach ) sebagai penelaahan terhadap kebebasan berpendapat di tengah pandemi sebagai dasar kerangka berfikir dalam mengkaji legal issue yang diteliti. hingga di peroleh simpulan pembatasan hak menyampaikan pendapat di muka umum pada massa pandemi covid-19 bukan pelanggaran hak asasi manusia dengan dasar Pemerintah diberi kewenangan membatasi hak kebebasan berpendapat seperti yang ada dalam Pasal 28J UUD NRI Tahun 1945 dan perlindungan hukum yang dapat diberikan yaitu perlindungan hukum reprentif yang diberikan sebelum terjadinya pelanggaran dan perlindungan hukum represif yang diberikan melalui judicial review Mahkamah Agung, Komnas HAM, dan gugatan PTUN.
