Abstract

The economic development in societies today is increasingly erratic. When it comes to economics, there will be a lot of things that can be discussed.As one example is, the matter of debt. Debts arise because an agreement is made by parties. Basically it does not matter, if the debt is paid on time. It is aproblem, however, when one failsto repay the debt as agreed upon. Thiswouldthen generate legal efforts to collect the debt, such as by a bankruptcyapproach. However, the recent bankruptcy law in Indonesia does not set the minimum requirement for the amount of debt a debtor can be equaled. It is then a problem for debitors who have more assets or assets than passiva or her debts. The type of research used in this study is normative-law research by conducting research on common law norms in Indonesia related to issues raised. The approach used by authors in research this time is legislation, conceptual approaches, and comparative approaches. Based on the study of legal material obtained, the arrangement for a minimum of debt requirement for a debtor can be issued is not met in the 2004act number 37 on bankruptcy and a delay in debt payments. The importance of this arrangement is to avoid debtors from creditors' bad faith that can do harm to them. The government is optimistic the rupiah will continue tostrengthen to rp9,100 per dollar, he said. As for the advice that can be given to law enforcement and lawmakers,the setting of the minimum principles of debt must be strictly regulated within the bankruptcy act in Indonesia. Since it is not uncommon for some creditors to have bad faith intentionally to bind the debtorsin behalf of those who claimtheirrights. Cardinal as ultimum remidium, should be able to render justice to his part. Whereas the bankruptcy act in Indonesia today focuses solely on creditors' interest.
