Abstract

Upaya Perlindungan Hukum Bagi Pengelola Rumah Susun Sederhana Sewa Terhadap Penghuni Yang Melakukan Wanprestasi ini merupakan penelitian yang akan menjawab masalah tentang akibat hukum dan perlindungan hukum jika penghuni rusunawa melakukan wanprestasi dalam perjanjian sewa menyewa rusunawa. Undang-Undang Republik Indonesia Nomor 20 Tahun 2011 tentang Rumah Susun menyebutkan pengertian mengenai rumah susun. Dibangunnya rusunawa merupakan salah satu program pemerintah dalam memenuhi kebutuhan perumahan dan pemukiman terutama didaerah perkotaan dengan jumlah penduduk yang tinggi, tetapi kurangnya lahan yang memadai dan rumah susun sederhana sewa ini ditujukan kepada masyarakat berpenghasilan rendah. Rusunawa dapat dihuni dengan cara disewa, yang dimana pembayaran sewa hunian dilakukan setiap bulan dan terdapat beberapa persyaratan yang harus dipenuhi terlebih dahulu oleh calon penyewa. Pelaksanaan perjanjian dalam sewa-menyewa rusunawa timbul karena adanya kesepakatan antara pengelola dengan penyewa sehingga menimbulkan hubungan hukum, dan bagaimana perlindungan hukum bagi pengelola jika pihak penyewa semena-mena mengenai penyalahgunaan aturan yang sudah disepakati oleh kedua belah pihak.
