Abstract

Cryptocurrency merupakan nama yang digunakan untuk suatu sistem komputer yang bernama Kriptografi. Uang kripto atau cryptocurrency dalam uang virtual menjadi salah satu objek ragam investasi yang menjadi bukti perkembangan teknologi dalam sektor penanaman modal. Dimana uang kripto di percaya memiliki nilai yang tinggi dan peredarannya juga masih tinggi. Saat ini kasus penipuan dalam trading kripto sedang memuncak dikarenakan kurangnya wawasan masyarakat yang hanya menginginkan keuntungan tinggi. Penipuan tersebut menyebabkan hilangnya harta para korban sedang pelaku dipidana penjara. Dalam faktualnya masyarakat yang ditipu pastinya menginginkan hartanya kembali. Selanjutnya, penelitian ini bertujuan untuk mengkaji restitusi dan konsep restitusi yang dapat mengembalikan hak bagi korban penipuan uang kripto. Sedangkan jenis penelitian yang digunakan adalah hukum normatif dengan pendekatan Peraturan Perundang-Undangan, Pendekatan Konseptual, dan Pendekatan Kasus. Hasil penelitian yang diperoleh adalah bahwa seharusnya pengganti kerugian dengan restitusi dapat lebih diutamakan agar hak-hak korban tersebut terpenuhi dan terlindungi sesuai Undang-Undang Perlindungan Konsumen dan konsep pendekatan restorative justice, serta terkait konsep restitusi didapat beberapa upaya korban untuk mendapatkan hak hartanya yakni upaya ganti kerugian berdasarkan perbuatan melawan hukum atau wanprestasi; upaya permintaan penggabungan perkara gugatan ganti kerugian; dan upaya permohonan restitusi kepada pengadilan melalui Lembaga Perlindungan Saksi dan Korban (LPSK).
