Abstract

Pelaku kejahatan adalah orang yang dengan sengaja melakukan tindakan yang dilarang oleh hukum, yang dapat dilakukan seorang diri ataupun berkelompok dengan perbuatannya yang dianggap dapat melanggar norma sehingga secara tegas disebut sebagai kejahatan. Khususnya kejahatan yang umum terjadi dalam kehidupan sosial adalah pencurian, sejumlah besar banyak orang yang menjadi korbannya. Pencurian adalah salah satu kejahatan tindak pidana yang dapat merugikan banyak orang karena kehilangan harta benda atau harta miliknya. Tanggung jawab atas pencurian didasarkan pada Kitab Undang-Undang hukum pidana bahwa pelaku harus bertanggung jawab jika tindakannya itu memenuhi unsur-unsur yang dapat terpenuhi berdasarkan yang diatur dalam pasal 362 KUHP dan beberapa hal lainnya yang akan digunakan sebagai pertimbangan dengan menggunakan pasal-pasal yang berkaitan dengan pencurian oleh penegak hukum. Yang menarik adalah dalam kasus pencurian ini sangat jarang terjadi terhadap pelaku pencurian yang mendapatkan hukuman karena tindakannya mencuri di perkebunan yang dapat menjerat pelaku dengan melakukan tindakannya yang mengambil hasil perkebunan berkaitan dengan kejahatannya yaitu yang diambil berupa getah rambung yang diketahui nilai barang tersebut terbilang sangat rendah. Namun dengan objek barangnya yang bernilai sangat kecil, pelaku masih tetap dapat dipidana. Penelitian ini menggunakan metode yuridis normatif yang pendekatannya dari Perundang-Undangan, konseptual, dan studi kasus yang tentunya membahas mengenai pertanggungjawaban pelaku tindak pidana pencurian. hasil penelitian ini memperlihatkan bahwa penegak hukum memberikan pengetahuan kepada semua masyarakat bahwa hukuman pidana atas tindak pidana pencurian tetap berlaku kepada siapa saja yang melakukan pencurian sekalipun dengan barang atau benda yang diambil itu bernilai sangat kecil, Hal ini dapat dijadikan pembelajaran bahwa tetap berlaku dilakukan pemidanaan terhadap pelaku pencurian, contohnya dengan menggunakan Undang – Undang Perkebunan terhadap pelaku pencurian getah rambung yang dengan sengaja mengambil hasil perkebunan milik perusahaan Jepang yang berdiri di Indonesia yaitu PT. Briedgestone, sehingga apa yang dilakukannya dapat dikatakan sebagai perbuatannya melanggar hukum.
