Abstract

Tujuan diadakannya penelitian ialah agar menemukan sebuah fatwa dan juga mencari mengenai kepastian dari hukum terhadap seseorang yang mengidap psikopat ketika sedang melakukan pembelaan diri (noodweer) dalam pasal 49 KUHP yang berakibat meninggalnya seseorang, apakah bisa dijatuhi pidana atau tidak. Peneliti menggunakan jenis penelitian hukum normatif dengan cara menginventarisasi dan juga mengkaji atau menganalisis dalam data sekunder yang terdiri dari bahan-bahan hukum primer dan juga dari bahan hukum sekunder dengan cara memahami hukum sebagai seperangkat peraturan ataupun norma-norma positif di dalam system sebuah perundang-undangan yang mengatur mengenai segala kehidupan pada manusia yang bertujuan agar menemukan mengenai segenap prinsip-prinsip hukum, aturan-aturan hukum, dan juga mengenai doktrin-doktrin hukum yang sebenarnya guna untuk memberikan sebuah fatwa atau jawaban dan mampu untuk memecahkan permasalahan mengenai isu hukum yang sedah diteliti. Dengan konsep yang telah peniliti buat, peneliti juga ingin menjelaskan mengenai alasan pembenar dan pemaaf dalam peniadaan pidana bagi pengidap psikopat dan mengkaji mengenai penentuan aturan hukum mana yang akan tepat untuk dapat dijatuhkan untuk seseorang pengidap psikopat. Sehingga mampu untuk memberikan sebuah jawaban mengenai kajian penelititan yang sedang diteliti.
