Abstract

Tindak pidana perdagangan orang sebagai terjemahan kata “Human Trafficking” dalam bahasa Inggris yang menjadi standar Internasional untuk mengidentifikasi segala kegiatan ilegal yang berkaitan dengan perpindahan atau transfer manusia dari suatu negara ke negara lain dengan tujuan memperoleh keuntungan secara komersial dengan cara mengeksploitasi sumber daya manusia tersebut tanpa mengindahkan atau menghormati hak-hak asasi manusia. Pertanggungjawaban pidana mengaitkan dasar-dasar penjatuhan sanksi pidana dengan beban tanggung jawab yang dibebankan kepada orang yang melakukan tindak pidana. Undang-Undang Nomor 21 Tahun 2007 tentang perdagangan manusia mengatur tentang sanksi pidana bagi mereka yang melakukan perbuatan perdagangan manusia. Batas maksimum dan minimum memberikan hakim kemampuan untuk menjatuhkan sanksi pidana kepada mereka yang terlibat dalam perdagangan manusia. Pemidanaan UU No. 21 Tahun 2007 merupakan awal dari ketidaksesuaian pemidanaan. Bagaimana pertanggung jawaban pidana terhadap pelaku tindak pidana perdagangan orang (Studi kasus Putusan Pengadilan Nomor 782/Pid.Sus/2020/Pn.Mtr.) ? Apakah Perkara Nomor 782/Pid.Sus/2020/Pn.Mtr telah memenuhi unsur TPPO ? Metode penelitian yang digunakan adalah penelitian hukum normatif. Pertanggung jawaban pidana terhadap pelaku tindak pidana perdagangan orang (Studi kasus Putusan Pengadilan Nomor 782/Pid.Sus/2020/Pn.Mtr.) adalah sesuai dengan ketentuan pada pasal 4 jo pasal 10 UU No. 21 Tahun maka terdakwa harus mempertanggung jawabkan sesuai dengan pasal yang telah dilanggar. Perkara Nomor 782/Pid.Sus/2020/Pn.Mtr telah memenuhi unsur TPPO, Unsur-Unsur TPPO yaitu unsur proses, unsur cara dan unsur tujuan.
