Abstract

Pesantren seharusnya menjadi lingkungan yang ramah dan aman baik bagi santri putra maupun putri. Di sisi lain, sejumlah pengajar di pondok pesantren sedang diselidiki karena diduga melakukan kejahatan seksual terhadap muridnya. Yang lebih memprihatinkan, guru atau pengajar pesantren tersebut melakukan pelecehan seksual. Selain untuk mewujudkan model pencegahan kejahatan seksual di Pesantren, penelitian ini bertujuan untuk pertama kali menetapkan pentingnya upaya pengaturan pencegahan kekerasan seksual di pesantren. dalam penelitian ini dirumuskan dua rumusan masalah yaitu: 1. Apa urgensi pemberian kewenangan kementrian agama di pondok pesantren untuk mencegah terjadinya kejahatan seksual, 2. Bagaimana optimalisasi pemberian kewenangan kementrian agama di pondok pesantren untuk mencegah terjadinya kejahatan seksual. Untuk mencari kebenaran mengenai pokok permasalahan yang dibahas, telah ditelusuri melalui hukum positif di Indonesia dan pengertian secara definitif dalam kamus bahasa Indonesia. Berdasarkan temuan penelitian, ditetapkan bahwa betapa pentingnya pengaturan pencegahan kekerasan seksual di Lembaga Pendidikan Pesantren mengingat beratnya dampak yang diterima oleh para korban dan langkah-langkah untuk menghentikan kekerasan seksual di pesantren dapat dilakukan dengan memperkuat pengawasan negara, pemerintah dan masyarakat terhadap lembaga-lembaga tersebut, memberikan nasihat hukum tentang risiko kejahatan seksual agar santri, khususnya santriwati, dapat mengambil tindakan yang tepat jika mereka menjadi korban, dan membuat posko pengaduan kejahatan seksual di Institut. pembinaan pondok pesantren dan Kementerian Agama mengawasi pondok pesantren
