Abstract

Ganja digunakan untuk kepentingan pembuatan obat dikarenakan memiliki beberapa kandungan senyawa kimia yang dapat menyembuhkan beberapa macam penyakit. Dijelaskna bahwa Ganja termasuk dalam salah satu jenis narkotika golongan 1 karena mempunyai kandungan tetrahidrokanabinol (THC), pada UU Narkotika bahwa istilah “mengkonsumsi” ini tidak dijelaskan. Beberapa pasal dari UU Narkotika tersebut hanya menjelaskan atau mencantumkan seperti : menggunakan, menyimpan, memiliki, menyediakan, menguasai, menawarkan, menjadi perantara, menkar untuk diperjual belikan, menerima, atau menyerahkan. Penelitian ini merupakan penelitian hukum noematif dengan pendekatan perundang – undangan dan konseptual dengn menemukan pengaturan penggunaan ganja sebagai bahan baku produksi obat, dan bagaimana aturan atau akibat hukum jika melanggar ketentuan terhadap penggunaan ganja sebagai bahan baku produksi obat. Pasalnya hingga saat ini masih banyak masyarakat indonesia yang menggunakan ganja secara illegal sebagai alternatif pengobatan atau menggunakan ganja yang diolah secara tradisional
