Abstract

Based on the description of Article 15 paragraph (3) Law No.2/2014 in conjunction with Law No.30/2004) which states that a notary has the authority to legalize electronic transactions (cyber notary). With the existence of this cyber notary concept, the notary in carrying out its functions has a close relationship with the electronic system through the internet as the main medium for making notarial deeds. Arrangements that provide an opportunity for the inclusion of the cyber notary concept can also be seen in Article 5 paragraph (2) and paragraph (3) of Law No.19/2016 in conjunction with Law No.11/2008 which explains that information or electronic documents and their printouts are legal evidence. legitimate. However, if you refer to the elucidation of Article 1 point 7 of Law No.2/2014 in conjunction with Law No.30/2004 which states that a notary deed is an authentic deed drawn up by or before a notary in accordance with the procedures set out in this law on notary office, thus giving rise to conflict with the enactment of notary services by applying the concept of cyber notary which in the process of making deeds and the procedures for dealing with the parties are carried out electronically such as via teleconference or video call. The purpose of this study is to identify and explain the arrangements and responsibilities of a notary in making electronic-based deeds (cyber notary). The arrangements regarding the making of an electronic-based deed (cyber notary) are still unclear and the notary cannot be held accountable as long as the process of making it does not violate Law No.2/2014 in conjunction with Law No.30/2004 and the Notary Code of Ethics, therefore the government is expected to make clear regulations related to the technical and mechanism of making electronicbased deeds (cyber notary) so that they can understand how far the notary is responsible for the electronic-based deeds he makes.
