Abstract
Dalam Pasal 143 ayat (2) huruf b telah dijelaskan mengenai sayarat materiil surat dakwaan, syarat materiil menjadi penting mengingat tidak dipenuhinya syarat tersebut dapat mengakibatkan dakwaan mudah mendapatkan eksepsi akibat dakwaan kabur (obscuur libel) atau bahkan bisa menimbulkan dakwaan batal demi hukum. berkaitan dengan tidak adanya landasan hukum bagi jaksa penuntut umum untuk merumuskan locus delicti dalam kejahatan siber, dalam penelitian ini dirumuskan dua rumusan masalah yaitu: 1. Apakah landasan perumusan locus delicti dalam surat dakwaan pada kejahatan siber telah diatur dalam hukum acara pidana di Indonesia; 2. Bagaimana aturan hukum yang tepat mengenai landasan perumusan locus delicti dalam surat dakwaan pada kejahatan siber. Untuk mencari kebenaran mengenai pokok permasalahan yang dibahas, akan ditelusuri melalui hukum positif di Indonesia, doktrin, dan pengertian secara definitif dalam kamus bahasa Indonesia. Dari hasil penelitian, ditemukan bahwasannya landasan bagi jaksa penuntut umum untuk merumusan locus delicti dalam surat dakwaan pada kejahatan siber masih belum terdapat di aturan hukum positif Indonesia, sehingga dapat dikatakan terdapat kekosongan hukum dalam permasalahan ini
