Abstract

Penelitian ini bertujuan untuk menganalisis tentang tata teknis eksekusi hak tanggungan berdasarkan grosse akta pengakuan utang, karena dalam pembuatan grosse akta harus melalui syarat- syarat yang telah ditentukan dan diperlukan untuk dicantumkan dalam grosse akta pengakuan utang. Dan peneliti meneliti dari segi Undang-Undang Hak Tanggungan, Undang-undang jabatan Notaris dan KUH Perdata serta Hukum Acara Perdata. Tipe penelitian ini merupakan penelitian normatif, untuk memperoleh bahan hukum peneliti menggunakan beberapa pendekatan yakni pendekatan udang-undang (Statute Approach) dan pendekatan konsep (conceptual approach). Peneliti juga menggunakan bahan hukum primer yang diperoleh dari beberapa ketentuan perundang-undangan antara lain UUJN, UUHT, KUH Perdata, HIR (Herzein Indlandsch reglement) atau hukum Acara Perdata, bahan hukum skudner yakni merupakan publikasi jurnal-jurnal hukum. Pengumoulan bahan hukum dilakukan melalui studi kepustakaan yang dianalisis secara deskriptif normatif. Hasil penelitian menunjukan bahwa grosse akta pengakuan utang memiliki titel eksekutorial namun sangat disayangkan bahwa pelaksanaannya banyak sekali kendala yang dihadapi begitupula pada ketentuan yang termaktub dalam hak tanggungan, memiliki titel eksekutorial pada APHT sebagai pengganti grosse akta hipotik namun terjadi inkosistensi norma pada UUHT sehingga menjadi kendala pihak kreditur dalam mengeksekusinya.
