Abstract

Fenomena kejahatan di tengah kondisi PSBB, banyak pelaku yang merupakan eks napi program asimilasi yang dikeluarkan oleh pemerintah melalui KementerianHukumdan HAM. Namun, sungguh miris karena alasan para eks napi yang kembali melakukan kejahatan tersebut justru terpaksa melakukan kejahatan kembali karena himpitan ekonomi di tengah kondisi PSBB.Penelitian ini bertujuan untuk mengetahui dasar hukum pembebasan narapidana pada masa pandemi covid-19 di Indonesia dan Untuk mengetahui akibat hukum jika negara tidak melakukan pembebasan narapidana pada masa pandemi covid-19.Metode penelitian yang digunakan dalam skripsi ini menggunakan metode penelitian hukum normatifyang merupakan penelitian kepustakaan, yaitu penelitian terhadap peraturan perundang-undangan dan literature yang berkaitan dengan materi yang dibahas. Berdasarkan hasil penelitian dapat disimpulkan pertama : Bahwa dasar hukum pembebasan narapidana pada masa pandemi covid-19 di Indonesia adalah merujuk pada perintah kapolri yang berprinsip:”Salus Populi Supreme Lex Esto” atau Keselamatan Rakyat Menjadi Hukum Tertinggi. Tujuan sistem pemasyarakatan ini ditetapkan dalam Pasal 9 Undang-Undang Nomor 12 Tahun 1995 tentang Pemasyarakatan (Undang- Undang Pemasyarakatan). Secara sederhana, ketentuan pasal ini mengungkapkan perlunya upaya melakukan pembinaan dan bimbingan kepada narapidana dengan kerja sama antar instansi pemerintah terkait, lembaga/badan kemasyarakatan, atau individu dalam menjalankan fungsi sistem pemasyarakatan. Sistem pemasyarakatan di Indonesia, mengenal adanya “pembebasan bersyarat” atau proses melepaskan narapidana dari penjara dengan berbagai syarat tertentu yang merupakan unsur krusial dalam membebaskan narapidana.
