Abstract

Peraturan pengangkatan pelaksana tugas kepala daerah telah diatur dalam Undang- Undang Nomor 10 Tahun 2016 tentang Pilkada Pasal 201 ayat (10) “Untuk mengisi kekosongan jabatan Gubernur, diangkat penjabat Gubernur yang berasal dari jabatan pimpinan tinggi madya sampai dengan pelantikan Gubernur sesuai dengan ketentuan peraturan perundang-undangan.” Selain itu, menurut Peraturan Mentri Ada pula dalam ketentuan penunjukkan kepala wilayah termuat dalam ketentuan Peraturan Menteri Dalam Negeri Nomor 74 Tahun 2016 sebagaimana telah diubah dengan Peraturan Mentri Dalam Negeri Nomor 1 Tahun 2018 tentang Perubahan Atas Peraturan Menteri Dalam Negeri Nomor 74 Tahun 2016 Tentang Cuti Di Luar Tanggungan Negara Bagi Gubernur Dan Wakil Gubernur, Bupati Dan Wakil Bupati, Serta Wali Kota Dan Wakil Wali Kota pada Pasal 4 Ayat 2 tentang cuti di luar tanggungan negeri, yang menyatakan bahwa “penjabat gubernur berasal dari pejabat pimpinan tinggi madya/ setingkat di lingkup pemerintah pusat/ provinsi.” Dalam Pasal 201 ayat (10) Undang-Undang Nomor 10 Tahun 2016 tentang Pilkada, saat ini menjadi pertentangan dan perdebatan dalam masyarakat. Oleh karenanya, timbullah dua pengembangan permasalahan dari penelitian ini yakni, alasan yang mendasari anggota TNI Polri menjadi pelaksana tugas kepala daerah berdasarkan Pasal 201 UU No. 10 Tahun 2016 tentang Pemilihan Kepala Daerah dan apakah nantinya timbul kembali pengaktifan dwifungsi ABRI akibat dari penelitian ini. Jika dilihat dari sejarah dan peraturan perundangan yang mengatur terkait hal tersebut, dapat disimpulkan penelitian ini tidak akan menimbulkan pengaktifan kembali tugas dwifungsi ABRI dan kemunduran sitem demokrasi di Indonesia.
