Abstract

Anggota kepolisian sering disalahkan karena tindakan-tindakan yang di ambil secara spontanitas dalam mengambil sebuah tindakan. Tindakan-tindakan terpaksa yang di ambil misalnya seperti melakukan penembakan sering di pertanyakan. Apakah tindakan tersebut memang seharusnya dilakukan ataukah harus melalui teknis teknis khusus sehingga anggota kepolisian dapat mengambil sebuah tindakan tegas dengan melakukan sebuah penembakan. Sehingga harus ada aturan aturan yang memberikan perlindungan kepada anggota kepolisian agar anggota kepolisian dapat menjalankan tugas yang di berikan dengan baik, serta anggota kepolisian tidak selalu di persalahkan dari tindakan yang dihasilkan dari perbuatannya untuk menjalankan tugasnya. Tugas yang dilaksanakan oleh anggota kepolisian memang banyak yang berhubungan langsung dengan masyarakat sehingga membuat pendapat orang akan pelaksanaan tugas anggota polri memang beragam dan tidak semua anggota polri yang terbukti melakukan tindakan pidana seperti penembakan dapat di jatuhi pidana. Ditinjau dari apa yang telah paparkan dalam latar belakang di temukan suatu rumusan masalah Apakah penembakan oleh polri dalam melaksanakan tugas dapat di kategorikan sebagai pembelaan terpaksa berdasarkan Pasal 49 Ayat (1) KUHP dan Bagaimana perlindungan hukum terhadap anggota polri yang melakukan penembakan. Yang menggunakan Jenis analisis hukum yang penulis gunakan adalah metode penelitian normatif yang dimana penulis ingin berfokus pada hukum positif yang ada pada peraturan perundang-undangan dan lainya. Menghasilkan kejelasan hukum bagi anggota Polri yang menjalankan tugasnya. Maka perlu adanya sebuah perlindungan hukum kepada anggota kepolisian yang melaksanakan tugas terlebih pengambilan tindakan tegas dengan secara terpaksa melumpuhkan bahkan hingga mengakibatkan seseorang mati.
