Abstract

Pekerja migran merupakan salah satu jalan untuk mencari pendapatan yang sangat dibutuhkan dalam kehidupan sehari-hari. Setelah pandemic COVID-19 telah mereda peminat pekerja migran kembali meningkat, yang dikarenakan sebelumnya sempat dibatasi pemberangkatannya. Dengan banyaknya jumlah peminat pekerja migran maka semakin banyaknya juga pengaduan permasalahan yang di timpa oleh Pekerja Migran Indonesia. Dari tujuan penelitian ini adalah untuk mengetahui dan memahami pemerintah Indonesia dapat memiliki kewenangan untuk memberikan perlindungan hukum terhadap pekerja migran Indonesia yang mengalami kekerasan di luar negeri, serta pemerintah juga memiliki tanggung jawab terkait kepulangan Pekerja Migran Indonesia ke daerah asal. Dalam penelitian jurnal ini menggunakan metode normatif dan menggunakan pendekatan peraturan Undang-Undang, serta Konvensi Internasional yang mengatur Perlindungan Hak Pekerja Migran dan Anggota Keluarga. Hasil penelitian ini menunjukkan bahwa pemerintah bertanggung jawab untuk memberikan perlindungan hukum terhadap Pekerja Migran Indonesia baik terprosedur maupun non prosedur. Perlindungan hukum yang di dapat pada Pekerja Migran secara prosedur di mulai dari pra penempatan, selama penempatan, pasca penempatan, serta tidak lepas dari perlindungan jaminan sosial apabila Pekerja Migran mengalami sakit. Untuk perlindungan hukum bagi Pekerja Migran Indonesia yang non prosedur sangat sulit untuk dilakukan karena tidak adanya dokumen secara resmi. Sehingga, untuk saat ini pemerintah mangupayakan untuk mencegah keberangkatn Pekerja Migran non procedural. Untuk memberikan perlindungan hukum dan pencegahan maka pemerintah membutuhkan Kerjasama antar instansi pemerintahan baik itu Kementerian Luar Negeri, Kementerian Dalam Negeri, BP2MI, LTSA, dan para pihak yang berkaitan. Pemulangan Pekerja Migran Indonesia juga merupakan tanggung jawab pemerintahan pusat dan daerah. Pemulangan Pekerja Migran ke daerah asal tidak dipungut biaya pada pekerja migran baik secara prosedur maupun non perosedur.
