Abstract

Skripsi ini berjudul “Pertanggungjawaban Pidana Pelaku Penggunaan Bahan Baku Makanan Kedaluwarsa (Studi Putusan Nomor 284/Pid.Sus/209/PN.Mjk)” yang memiliki tujuan hukum perlindungan konsumen secara langsung adalah untuk meningkatkan martabat dan kesadaran konsumen. Secara tidak langsung hukum ini juga tidak akan mendorong produsen untuk melakukan usaha dengan penuh tanggung jawab namun semata tujuan tersebut hanya dapat dicapai bila hukum perlindungan konsumen dapat diterapkan secara konsekuen. Singkatnya pada Putusan Nomor tersebut Terdakwa menggunakan bahan baku makanan kedaluwarsa pada super mie instant cap BUNGA TROMPET yang hal tersebut merupakan penyalahgunaan bahan baku makanan yang tidak layak konsumsi dalam mie instant tersebut sebaiknya pihak konsumen maupun pelaku usaha memahami betul tujuan dari perlindungan konsumen. Metode yang digunakan pada penelitian ini adalah yuridis normatif atau legal research, yaitu penelitian yang difokuskan untuk mengkaji penerapan kaidah-kaidah atau norma-norma dalam hukum positif. Penelitian ini dilakukan dengan cara mengkaji berbagai aturan hukum yang bersifat formil seperti undang-undang, serta literatur yang berisi konsep-konsep teoritis yang dihubungkan dengan permasalahan yang dibahas dalam penulisan. Adapun permasalahan atau rumusan masalahnya ialah bagaimana pertanggungjawaban pidana pelaku penggunaan bahan baku makanan kedaluwarsa serta apakah Putusan Nomor 284/Pid.Sus/2019/PN.Mjk telah memenuhi aspek keadilan hukum. Kesimpulan dari penelitian ini adalah pertanggungjawaban pidana korporasi masih merupakan masalah yang perlu dicari pemecahannya. Demikian pula masalah pertanggungjawaban pidana terhadap korporasi dalam tindak pidana di bidang perlindungan konsumen ini juga masih banyak mengandung kelemahan. Serta Putusan Nomor 284/Pid.Sus/2019/PN.Mjk belum memenuhi aspek keadilan hukum, karena perbuatan pelaku atau Terdakwa tersebut masih dapat memenuhi unsur Pasal 11 huruf a dan huruf b Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen yang apabila dikonsumsi dalam jangka Panjang akan menimbulkan penyakit bagi para konsumen yang mengonsumsinya. Sehingga putusan hakim tersebut tidak setimpal dengan perbuatan pelaku atau Terdakwa yang dapat merugikan konsumen. Kata Kunci : Kedaluwarsa, Pertanggungjawaban Pidana, Aspek Keadilan Hukum
