Abstract

The need to maintain immunity by getting vaccination injections containing the Covid-19 Vaccine during the Covid-19 Pandemic era is of course not only seen from the aspect of health services alone, but also as a business opportunity in the health sector. Several persons have used their authority in these circumstances to obtain some personal gain. One of these actions was carried out by unscrupulous civilians who are property agents and have many customers who ask to be assisted in getting the co-19 vaccine injection easily and quickly. Various methods were carried out to provide vaccinations to customers who needed vaccines, until finally the civilians who were property agents bribed other elements who were State Civil Apparatus (ASN) to use their authority to obtain the state's Covid-19 vaccine, namely the Covid-19 vaccine. 19 which is actually intended for inmates and public servants at Class 1 Prison Tanjung Gusta Medan, North Sumatra. Therefore, the author will conduct research related to the regulation of the sale of Covid-19 vaccines in Indonesia and the criminal responsibility of those selling Covid-19 vaccines that are not in accordance with their designation. This study uses a normative method in which the author will examine the relevant laws and regulations. The results of this study are that the actions of individuals selling Covid-19 vaccines that are not in accordance with their designation can be punished. Individuals who are civilians can be punished with imprisonment for a minimum of 1 (one) year and a maximum of 5 (five) years and a fine. ) years or a fine, as well as being dishonorably discharged from his position as a State Civil Apparatus (ASN).
