Abstract

Perkawinan beda agama tidak lagi asing bagi warga negara Indonesia, di Indonesia sendiri banyak terjadi perkawinan beda agama. Perkawinan beda agama yakni perkawinan yang dilakukan oleh pasangan pemeluk agama yang berbeda, namun perkawinan beda agama ini menjadi berdebatan dikalangan masyarakat dan para ulama terkait Sahnya suatu perkawinan dan tidak semua agama mengakui adanya perkawinan beda agama. Dalam UU Perkawinan, aturan terkait perkawinan beda agama belum diatur secara jelas, namun terdapat pengecualian dalam UU Administrasi bahwa perkawinan beda agama dapat meminta penetapan pengadilan agar dapat dicatatkan.Jenis penelitian yang digunakan adalah penelitian hukum normatif dengan melakukan penelitian terhadap norma hukum yang berlaku di Indonesia terkait dengan isu hukum yang diajukan. Metode pendekatan yang digunakan oleh penulis dalam penelitian kali ini adalah pendekatan perundang-undangan, pendekatan konseptual dan case approach.Berdasarkan penelitian terhadap bahan hukum yang diperoleh kesimpulan bahwa Pengaturan perkawinan beda agama dalam Undang-Undang belum diatur secara jelas, hal ini menimbulkan adanya “Menyiasati” bagi pasangan beda agama, namun dalam UU Administrasi Penduduk memberikan pengecualian terkait perkawinan beda agama bahwa perkawinan beda agama dapat dilakukan dengan penetapan pengadilan. Sahnya suatu perkawinan dalam UU Perkawinan harus berdasar pada hukum agamanya masing-masing, maka perlu adanya Harmonisasi Peraturan Perundang-Undangan. Harmonisasi Peraturan Perundang-Undangan ini dapat dilakukan dengan melakukan uji materiil terkait UU Perkawinan bahwa Pasal 2, Pasal 8, dan Pasal 12 perlu adanya penambahan aturan terkait perkawinan beda agama. Adapun saran untuk Lembaga eksekutif dan Legislatif untuk melakukan perubahan Undang-Undang yang mengatur tentang Perkawinan. Dengan tercapainya harmonisasi UU ini, maka terwujudnya kepastian hukum bagi pasangan beda agama.
