Abstract

Perkembangan teknologi internet pada saat ini merupakan salah satu menjadi yang popular terutama dikalangan remaja. Namun tidak sedikit dari mereka yang menjadikan internet menjadi sarana baru untuk melakukan kejahatan terhadap kesusilaan, yaitu tindak pidana cyberporn. Cyberporn merupakan salah satu bentuk pornografi yang dapat diaksesnya secara online melalui sebuah jaringan internet. Penegakan hukum tindak pidana cyberporn diatur dalam Undang Undang Republik Indonesia Nomor 11 Tahun 2008 Jo Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik; Undang-Undang No 44 Tahun 2008 tentang Pornografi dan KUHP tentang Pornografi. Permasalahan yang dikaji dalam penelitian ini adalah : (1) Bagaimana perluasan makna pornoaksi dalam aplikasi media sosial Bigo Live . (2) Bagaimana upaya untuk mencegah terjadinya tindak pidana cyberporn di media sosial berbasis live streaming video. Metode penelitian yang digunakan yaitu pendekatan kualitatif dan jenis penelitian yuridis sosiologis atau yuridis empiris. Data yang diperoleh dengan melakukan wawancara, studi pustaka dan kuesioner. Hasil penelitian dari penelitian ini adalah : (1) Pentingnya peran dari aparat penegak hukum dalam melakukan penegakan hukum di Indonesia dalam tindak pidana cyberporn berbasis live streaming video. (2) Upaya dalam melakukan pencegahan pada kejahatan tindak pidana cyberporn yang marak di aplikasi Bigo Live dan dengan menggunakan kebijakan kriminal agar tidak terulang lagi dengan kasus lainnya dan menjadikan masyarakat lebih waspada lagi akan kejahatan pada tindak pidana cyberporn. Kesimpulan dari penelitian ini adalah (1) Penyalahgunaan pada aplikasi Bigo Live yang masih banyaknya konten konten yang mengandung unsur pornografi telah melanggar UU ITE, UU Pornografi dan KUHP dan karena masih banyaknya yang salah menafsirkan maka terbitlah Keputusan Bersama tentang Pedoman Implementasi atas pasal tertentu pada UU ITE (2) Upaya pencegahan yang dilakukan untuk tindak pidana cyberporn dengan melakukan kebijakan kriminal/ penal policy dengan menggunakan dua jalur yaitu sarana penal dan sarana non penal.
