Abstract

Menurut Pasal 1 Angka 26 Kitab Undang-Undang Hukum Acara Pidana, baik Penuntut Umum maupun Penasihat Hukum tidak boleh mengajukan saksi-saksi yang dianggap memenuhi syarat sebagai saksi yang memenuhi syarat. Menurut Pasal 185 ayat (6) huruf a Kitab Undang-Undang Hukum Acara Pidana, salah satu faktor utama yang harus diperhatikan oleh hakim majelis dalam menentukan benar tidaknya keterangan saksi adalah kesesuaian antara keterangan saksi pertama dengan keterangan saksi lainnya. Penilaian ini juga tidak terlepas dari keyakinan hakim yang akan ditentukan oleh alat bukti yang diberikan oleh saksi. Pada dasarnya saksi testimonium de auditu ini tidak dapat dikatakan sebagai saksi yang sah atau tidak dapat untuk diterima sebagai alat bukti dalam proses pembuktian. Di bidang hukum pidana, istilah pidana dan pemidanaan yang digunakan secara bergantian. Akan tetapi, istilah pemidanaan lebih tepat diartikan sebagai “penderitaan yang dengan sengaja dijatuhkan atau diberikan oleh negara kepada seseorang atau beberapa orang sebagai akibat hukum (sanksi) baginya atas perbuatannya yang melanggar larangan hukum pidana”. Karena hampir semua pembuktian perkara pidana tergantung pada pemeriksaan alat bukti saksi, maka keterangan saksi sangat penting dalam proses pembuktian suatu perkara di pengadilan. Namun, hakim tetap bergantung pada bukti-bukti yang dihadirkan, pengadilan dapat mempertimbangkan segala sesuatu yang berkaitan dengan bersalah atau tidak bersalahnya terdakwa. Keterangan saksi merupakan salah satu alat bukti berdasarkan alat bukti yang diatur dalam Undang-Undang Nomor 8 Tahun 1981 tentang Kitab Undang-Undang Hukum Acara Pidana (KUHAP). Dalam penanganan perkara pidana, alat bukti berupa keterangan saksi memiliki bobot hukum. Keterangan saksi ini diprioritaskan dalam proses verifikasi dan berpotensi menjadi alat bukti yang paling signifikan saat perkara disidangkan.
