Abstract

Perkembangan teknologi informasi dan komunikasi dimanfaatkan sebagai sarana tindakan perjudian, hal ini tentu saja menjadikan perjudian online semakin tumbuh subur di negeri kita. Metode penelitian ini melalui pendekatan yuridis normatif yang bersumber dari data primer, yaitu perUndang-Undangan, teori hukum, studi kasus, putusan pengadilan. Metode pengumpulan bahan yakni kajian terhadap bahan hukum primer yaitu peratutan perUndang-undangan dan literatur-literatur yang berkaitan dengan tema. Tujuan dalam penelitian ini adalah untuk menjelaskan bagaimana bentuk pertanggungjawaban hukum terhadap pihak yang terlibat judi online slot dan bagaimana Ratio Decindendi dalam menjatuhkan putusan terhadap pelaku judi online slot melalui transaksi elektronik bedasarkan Putusan Nomor 2283/Pid.B/2021.Sby. Tindak pidana perjudian merupakan salah satunya kejahatan yang meresahkan masyarakat serta sering terjadi. Munculnya tindak pidana tersebut di karenakan ketidakstabilan kondisi masyarakat baik dari kesadaran hukum, moral, ekonomi serta religi. Saat ini perjudian beralih ke tempat yang lebih elit karena seiring dengan teknologi yang berkembang. Jumlah pengguna internet di Indonesia selaras dengan kemajuan teknologi serta informasinya, namun sangat disayangkan karena sering kali kemajuan teknologi serta informasi tersebut dimanfaatkan guna melakukan kejahatan oleh sebagian orang dalam dunia cyber crime (digital). UU ITE dibentuk untuk mengantisipasi segala bentuk cyber crime yang melibatkan penggunaan teknologi informasi, yang sesuai terhadap makin melonjaknya intensitas globalisasi, konvergensi serta digitalisasi dari teknologi informasi yang berkelanjutan, yang berpeluang disalah gunakan untuk melaksanakan tindak pidana.
