Abstract

Penelitian ini bertujuan untuk mengetahui objek praperadilan pasca putusan Mahkamah Konstitusi yang menambahkan penetapan tersangka sebagai objek praperadilan yang diatur UU RI Nomor 8 tahun 1981 tentang KUHAP. Metode penelitian ini melalui pendekatan yuridis normatif yang bersumber dari bahan hukum primer dan bahan hukum sekunder. Metode pengumpulan bahan yakni kajian terhadap bahan hukum primer dan bahan hukum sekunder yang berkaitan dengan objek penelitian kemudian dianalisis secara normatif. Hasil penelitian menunjukkan bahwa putusan Mahkamah Konsitusi Nomor 21/PUU-XII/2014 tanggal 28 April 2015 telah merombak objek praperadilan yang diatur dalam KUHAP yang bersifat limitatif dengan menambahkan penetapan tersangka, penggeledahan dan penyitaan. Tujuan Mahkamah Konstitusi merombak objek praperadilan salah satunya yaitu pada penetapan tersangka dengan tujuan melindungi warga negara dari kesewenang- wenangan aparat penegak hukum. Pertimbangan hakim dalam memutus perkara tersebut dengan tujuan pengakuan, perlindungan, jaminan dan kepastian hukum. Akibat hukum atas putusan Mahkamah Konstitusi tersebut, objek praperadilan sebagaimana diatur dalam KUHAP harus dimaknai termasuk penetapan tersangka, penggeledahan dan penyitaan.
