Abstract

Dalam penelitian ini bertujuan untuk mengetahui dan menjelaskan pertimbangan oleh hakim dalam penjatuhan pidana terhadap Pecandu Narkotika Golongan I jenis ganja pada putusan pengadilan Nomor 761/Pid.Sus/2021/PN Jmr. Tulisan ini mengikuti pendekatan kasus, pendekatan perundang-undangan dan pendekatan konseptual dengan penelitian normatif. Dalam penyelesaian perkara tindak pidana Narkotika dengan penerapan pembinaan dan perawatan dalam bentuk Rehabilitasi, bukan dengan pidana penjara. Seperti perkara tindak pidana Narkotika dengan putusan pengadilan Nomor: 761/Pid.Sus/2021/PN Jmr terhadap terdakwa Mohammad Rifki Ananda yang dimana hakim memutus terdakwa bukan dengan putusan Rehabilitasi medis dan/atau sosial, melainkan putusan pidana penjara selama 1 (satu) tahun. Berdasarkan Pasal 54 Undang-Undang Narkotika bahwa Pecandu Narkotika, Penyalahguna Narkotika dan Korban Penyalahgunaan Narkotika wajib menjalani Rehabilitasi medis dan Rehabilitasi sosial. Diperkuat dengan Pasal 103 Undang-Undang Narkotika yang dimana Pasal tersebut merupakan pedoman bagi aparat penegak hukum yaiu Majelis Hakim dalam memutus dan menetapkan untuk memerintahkan yang bersangkutan menjalani perawatan berupa Rehabilitasi dengan terbukti maupun tidaknya dalam persidangan. Berdasarkan ketentuan dalam Surat Edaran Mahkamah Agung Nomor 04 Tahun 2010, bahwa terdakwa juga telah memenuhi ketentuan tersebut untuk menjalani Rehabilitasi bukan dengan pidana penjara. Maka dari itu, kesimpulannya bahwa berdasarkan dari Putusan Pengadilan Nomor: 761/Pid.Sus/2021.PN Jmr, hakim tidak mempertimbangkan dan memperhatikan dan menafsirkan setiap Ayat di dalam Pasal 127.
