Abstract
Behind the argument for imposing chemical castration sanctions on perpetrators of pedophilia crimes, which are classified as serious crimes because of the high number of victims and cause psychological trauma and harm to children who still have a future. Therefore, the Indonesian government took this matter seriously and enacted Law Number 17 of 2016, which provides additional penalties for perpetrators of pedophilia in the form of chemical castration. This additional punishment is the cause of the state's concern for the nation's children and future generations. However, this poses a dilemma for doctors who have their own profession and experience in the medical field, which is where doctors are appointed to be the executor team in assisting prosecutors in the execution of chemical castration against criminals. The chairman or President of the Indonesian Doctors Associatio n (IDI) said he would reject the use of doctors as enforcers of chemica l castration sanctions. The involvement of the medical profession in the criminal process through chemical castration is contrary to the Code of Ethics or (Oath) and Law Number 29 of the Year of Medical Practice 2004 which they use as guidelines in carrying out all their duties. The author focuses on the legal position of a doctor who rejects chemical castration. In this writing, it uses research methods of the statutory approach (Statue Approachd) and the conceptual approach (Conceptual Approach). Because the Code of Ethics is not a law, the Code of Ethics is not a legislative action, but a rule in medicine that is usually only accepted by certain groups if determined by the Indonesian Doctors Association (IDI). So the doctor must obey the statutory order to carry out his duties as an assistant prosecutor to be the executor of the chemical gelding because hierarchically the law is the highest position and this is also the order of the state.
