Abstract

Perjalanan panjang mengenai pemindahan IKN telah sampai pada masa sekarang yaitu pada masa Presiden Joko Widodo bahwa pada pertengahan Maret 2022 dimulainya pembangunan (IKN) di tengah wilayah Indonesia tepatnya di daerah Kalimantan Timur yang akan ditargetkan pada tahun 2024 akan dimulai pemindahan secara bertahap hingga 2045. Kepala Otorita Ibu Kota Negara Nusantara (IKN) beserta wakilnya resmi dilantik pada 10 Maret 2022. Kepala Badan Otoritas Ibu Kota Negara Nusantara dan Wakilnya dipilih secara langsung oleh Presiden Republik Indonesia. Hal ini sesuai dengan Pasal 5 ayat (4) serta Pasal 9 ayat (1) Undang-Undang Republik Indonesia Nomor 3 Tahun 2022 tentang Ibu Kota Negara. Penunjukkan langsung tersebut menjadi problematika di kalangan masyarakat dan akademisi. Hal tersebut dinilai telah terjadi kemunduran demokratisasi yang tidak sama halnya dengan prinsip yang dijelaskan pada Pasal 18 ayat (4) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Peristiwa ini menjadi yang pertama kali, karena sebelumnya sebuah daerah otonomi khusus atau ibu kota negara sekalipun diselenggarakan oleh Pemerintah Daerah bukan Badan Otorita.
