Abstract

The legal obligation of mineral and coal management and refining is a form of hypothetical imperative legal norm mandated under Article 102 of Law No. 3 of 2020 concerning Amendments to Law no. 4 of 2009 concerning Mineral and Coal Mining. This hypothetical imperative norm is the embodiment of nastonalism recauses and provides the greatest benefit and aims to provide prosperity and welfare of the people. The obligation to build and clean up through a smelter facility is a form of sustainable mineral and coal mining governance as well as responding to the need for the fulfillment of domestic industrial raw materials or downstream. In responding to the challenges of the rise of nationalism and legal politics, law as a means of changing people's behavior formulates norms for domestic management and purification which at the same time gives meaning to ownership of assets (minerals and coal) as renewable energy so that their management is carried out with principles, benefits and justice. and sustainable. Another meaning of Article 102 is that the concept of added value is only based on management and refining, but a change in the perspective of the management of goods turning into finished or semi-finished goods, all of which are benefits for the nation and state. As a legal norm, it is detrimental to the shortcomings in its application, especially to the implementation of sanctions which are felt to have not provided legal certainty. Historically, the contract system has shifted to the concept of a licensing system, which is a modern mining management system. A philosophy of management and refining of minerals and coal is to make a change in the community towards the obligation to carry out management and cleaning actions through the smelter facility with the function of increasing the economy and aiming to meet the security of the people's welfare and prosperity.
