Abstract
Technological developments have an impact on the development of law, including criminal law, especially criminal acts. Crimes that often occur in society are criminal acts that violate decency in the field of information and electronic transactions. Like the case of Baiq Nuril Maknun who was supposed to be a victim of sexual harassment but instead became a suspect. The Baiq Nuril Maknun case has received a lot of attention from the public, academics and even the President. This case began with Balq Nuril Maknun, an honorary teacher at SMAN 7 Mataram, who recorded a telephone conversation with the principal of the school. The recording of the conversation was spread so that Baiq Nuril was reported by the school principal on suspicion of Article 27 paragraph (1) of the Electronic Information and Transactions Law (ITE). This research uses normative legal research, the problem approach used in this research is the statutory approach, conceptual approach, case approach, and comparative approach. The analysis of legal materials is described using the deductive method. The results of this study conclude that first, the ratio decidendi in criminal acts of information and electronic transactions (ITE) that violates morality the occurrence of different legal considerations in the same case. The Mataram court decided not guilty, while the Supreme Court at the Cassation and PK level decided guilty. Justice was only obtained after the granting of amnesty from the President. Second, legal protection for victims of criminal acts of information and electronic transactions (ITE) that violate decency where victims receive protection from the Witness and Victim Protection Agency (LPSK) in the form of fulfilling procedural rights and victims also receive protection from the President. in the form of granting amnesty as a protection for human rights.
