Abstract

The dissertation research entitled " The Nature Of Women's Legal Position In The Bali Traditional Community Instruction System Based On The Era Of Gender Equality" discusses the patrilineal system placing men in a superior position while women are in an inferior position in all respects including inheritance. As a result, women are not heirs in Balinese customary law. This violates the principles of justice, protection of human rights and gender equality. This study discusses two problems, namely 1) the nature of the ambivalence of the patrilineal system of the Balinese customary community towards the legal position of women and 2) the development of the Balinese traditional inheritance system on the legal position of women in the perspective of gender equality. This research is a normative juridical research that examines the nature of the legal position of women in the inheritance system of Balinese indigenous peoples which describes the dynamics of women's position in Balinese customary inheritance law. The research approach is carried out with a statutory approach, a legal concept approach, and a philosophical approach. The types of legal materials used are primary legal materials and secondary legal materials. The analysis was carried out qualitatively. Inheritance according to Balinese customary law is not identical with dividing the inheritance (inheritance) of parents and ancestors (heirs) by the heirs, but contains the meaning of preservation, management and forwarding of swadharma (responsibility) and swadikara (rights) of inheritance in various forms and forms. This condition is in line with the theory of human rights, namely cultural relativity. Balinese customary inheritance law has shifted where women are starting to be counted as heirs based on the Decree of the Supreme Pesamuhan Pakraman Village Bali Bali Number 01/KEP/PSM-3/MDP Bali/X/2010. However, the Decree is only a guideline for the Balinese indigenous people, not Balinese customary law. The legitimacy of women as heirs needs to be carried out in the renewal of Balinese customary inheritance laws based on the protection of human rights and gender equality.
