Abstract
Bankruptcy is a priori considered a failure caused by an error on the part of the debtor in running his business, causing the debt to be unable to be paid. Currently, the settlement of Islamic Bank disputes, especially bankruptcy, is experiencing legal problems or problems, namely the legal vacuum in the regulation of Sharia Bankruptcy. Sharia Bankruptcy which still has no regulation / legal vacuum so that it still uses the Bankruptcy Legal System adopted by the Law of the Republic of Indonesia Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations. The formulation of the problem in this dissertation is 1. The Urgency of the Authority of the Religious Courts to Adjudicate Sharia Bankruptcy. and 2. Concept of Authority of Religious Courts to Adjudicate Sharia Bankruptcy. Using the Theory of Authority Theory; Theory of Legal Objectives; Legal Protection Theory; Theory of Guarantee and Theory of Formation of Legislation and the Concept of Authority of the Religious Courts and the Concept of Sharia Bankruptcy. This dissertation uses a research method with a normative or doctrinal legal research type. The approaches used from the several approaches above are the philosophical approach, the statutory approach, the conceptual approach, and the comparative approach. The result of this dissertation research is that Bankruptcy Cases in Indonesia have not specifically dealt with Sharia Bankruptcy using sharia principles/sharia contracts. There are 3 (three) reasons for the urgency of the authority of the Religious Courts to adjudicate Sharia Bankruptcy, namely philosophical reasons, sociological reasons, and juridical reasons. The concept of the authority of the Religious Courts to adjudicate sharia bankruptcies is the concept of the Bankruptcy Institution in adjudicating Sharia Bankruptcy in Indonesia, namely the Religious Courts. Those who promote Peace maximize the value of on-going business and maintain the social benefits of business existence by Restructuring to develop plans to restructure the business of finance and merchant administration.
