Abstract

Law Number 5 of 1960 concerning Basic Regulations on Agrarian Principles (UUPA) is the only Land Law that applies in Indonesia. The UUPA states that the Land Law applicable in Indonesia is sourced from Customary Law. Land sale and purchase transactions in Indonesia are based on customary law which uses cash and light principles. Cash means that the transfer of rights occurs immediately with the payment, while light means that the sale and purchase is carried out before an official who has the authority to legalize the sale and purchase, namely the Land Deed Maker Official who has the authority to make a Sale and Purchase Deed. This research was conducted to find out the Legis Ratio of the use of "Light and Cash" in the Deed of Sale and Purchase of Land Rights and the Legis Ratio of the legal position of the Land Deed Making Official as a Public Official. The research method used is normative legal research using 4 (four) kinds of problem approaches, namely the statutory approach, conceptual approach, philosophical approach and historical approach. Based on the results of the study, it was found that the Legis Ratio used "Light and Cash" in the Deed of Sale and Purchase of Land Rights based on the UUPA is because the UUPA accommodates Customary Law as the basis for National Land Law. Cash means that the transfer of rights occurs immediately with the payment, while light means that the sale and purchase is carried out in front of an official who has the authority to witness the sale and purchase. The position of the Land Deed Making Official, although its existence is only regulated in a regulation at the level of a Government Regulation, but its position is equivalent to the position of a Notary and the Land Deed Official's deed is an authentic deed. The existence of PP No. 24 Th. 1997 and PP No. 37 Th. 1998 is an integral part of the UUPA because the two Government Regulations are the implementers of the provisions on Land Registration as stated in Article 19 of the UUPA so that these regulations are an inseparable series.
