Abstract
This dissertation research is entitled Ratio Legis of Marriage Agreement Making in Legal Protection Efforts Against Congenital Assets with the background that the regulation of marital property in Article 35 of Law Number 1 of 1974 concerning Marriage is still clean with multiple interpretations. So that in practice there are many problems that arise due to conflicts regarding marital property, especially regarding innate property because no previous marriage agreement was made. This dissertation raises two problem formulations, namely: (1) Characteristics of the structure of marital property according to the marriage law; (2) Ratio Legis for Making Marriage Agreements in Legal Protection Efforts Against Congenital Assets. The research method used in writing this dissertation is normative legal research, using analysis from various legal theories. The theory used in the dissertation research is the theory of legal protection, the theory of legal objectives, and the theory of agreement. The results of the dissertation research are as follows: (1) The structure and characteristics of property in marriage there are two types of assets, namely: First, joint assets with their characteristics are assets that are jointly owned by the wife and husband; second, is inherited property, the right of control and management is absolutely the private property of each husband and wife unless deviation is determined through a marriage agreement; (2) Article 35 of the Marriage Law which regulates marital property is still multi-interpreted, especially on the results of inherited assets obtained during the marriage period. Based on this position, the existence of a Marriage Agreement as regulated in Article 29 of the Marriage Law can be a way out by confirming that the type of property can join the parent's property or become joint property.
