Abstract
Pada saat ini pelecehan seksual dilakukan dengan cara ucapan (verbal) maupun tindakan secara langsung (non verbal). Tindakan pelecehan seksual begitu kompleks, dikarenakan telah menimbulkan rasa kecemasan dan meresahkan dilingkungan masyarakat. pelecehan seksual tidak muncul begitu saja, namun melalui proses pelecehan yang dianggap suatu tindakan yang normal oleh pelaku. Setiap pekeja mempunyai hak untuk mendapatkan perlindungan terhadap keselamatan dan kesehatan dalam bekerja, moral, kesusilaan, dan perlakuan harkat dan martabat yang baik. Penelitian ini menggunakan metode normative legal research dengan menelaah prinsip-prinsip hukum. Putusan hakim merupakan aspek penting yang diperlukan dalam menyelesaikan suatu perkara pidana. Hasil dari penelitian yaitu Menjatuhkan pidana penjara selam 5 (lima) bulan terhadap terdakwa tidak akan memberikan efek jera kepada terdakwa. Tidak memberikan rasa keadilan bagi korban, keluarga korban, serta nama baik insatansi Satuan Polisi Pamong Praja Majelis hakim seharusnya majelis hakim menjatuhkan pidana dengan menjamin tegaknya keadilan, kebenaran, dan kepastian hukum bagi masyarakat. The act of sexual harassment is so complex, because it has created a sense of anxiety and unrest in the community. Sexual harassment does not just appear, but through a process of harassment which is considered a normal act by the perpetrator. Every worker has the right to get protection for safety and health at work, morals, decency, and treatment with good dignity. This study uses a normative legal research method by examining legal principles. The judge's decision is an important aspect needed in resolving a criminal case. The result of the research is that the sentence of imprisonment for 5 (five) months against the defendant will not have a deterrent effect on the defendant. Does not provide a sense of justice for the victim, the victim's family, and the good name of the Civil Service Police Unit.
