Abstract

Binary Option Trading menjadi hal yang cukup banyak dibicarakan publik belakangan ini, dikarenakan banyak influencer dan iklan-iklan bertebaran mengenai keuntungan besar yang bisa didapatkan melalui Binary Option Trading, sehingga banyak masyarakat tergiur untuk mencoba masuk ke dalamnya tanpa memahami apa dan bagaimana sistem Binary Option itu sendiri. Selain itu, legalitas Binary Option Trading di Indonesia masih dipertanyakan. Mengenai jenis komoditi yang termasuk dalam subjek kontrak berjangka diatur dalam Peraturan Bappebti No. 3 Tahun 2019 tentang Komoditi, Binary option tidak termasuk dalam subjek yang tertulis di Pasal 1. Hal ini secara tidak langsung dapat diartikan bahwa Binary Option ilegal. Kasus terkini adalah skema binary option yang ditetapkan sebagai praktik perjudian. Kegiatan perjudian dilarang oleh Pasal 303 Kitab Undang-Undang Hukum Pidana (KUHP), Undang-Undang (UU) Nomor 7/1974, serta Peraturan Pemerintah Nomor 9/1981, dan UU Nomor 11/2008 (UU ITE). Maka timbul pertanyaan, Apakah ada alternatif pengaturan hukum perdata terhadap korban kasus trading binary option? Bagaimana pertanggung jawaban pelaku terhadap binary option yang berkedok investasi online? Dalam penelitian ini peneliti menggunakan penelitian hukum normatif, yaitu penelitian yang berguna untuk menemukan dan menjawab isu hukum, aturan hukum, prinsip-prinsip hukum ataupun doktrin- doktrin hukum yang dihadapi dilihat dari segi normatif dan untuk menemukan kebenaran apakah aturan hukum telah sesuai dengan norma hukum. Penelitian dari hukum normatif ini digunakan untuk memecah masalah terhadap issue hukum yang dihadapi dengan hanya meneliti norma hukum nya saja. Sehingga dari penelitian dengan metode hukum normatif akan menghasilkan preskripsi yang sesuai dan seharusnya menurut hukum. Kata kunci : Binary Option, Perjudian, Influencer.
