Abstract

Manusia memerlukan perkembangan dalam pemenuhan kebutuhan sehari-hari. Salah satunya, dalam hal bertransaksi. untuk memudahkan masyarakat dalam memenuhi kebutuhannya, maka dibentuklah alat pembayaran yang lebih modern dan salah satunya berupa bilyet giro. Dengan rekening giro, masyarakat dapat melakukan pembayaran secara non tunai dan menjadi lebih efisien. Sesuatu yang serba mudah, bukan berarti luput dari masalah. Bilyet giro dalam penggunaannya seringkali dijumpai permasalahan. Dalam hal ini, masalah yang terjadi dapat berupa kasus bilyet giro kosong. Akibat hukum berimbas pada pihak debitur yang melakukan wanprestasi karena menerbitan bilyet giro kosong, serta upaya hukum dapat diupayakan oleh kreditur yang dirugikan dari adanya bilyet giro kosong. Akibat hukum dapat berlaku apabila pelaku tidak menepati janjinya dan dikenakan terhadap debitur. agar dapat memenuhi kewajibannya membayarkan nominal yang tertulis dalam bilyet giro. Serta, upaya hukum dapat diupayakan oleh kreditur yang dirugikan dari adanya wanprestasi yang dilakukan debitur, sehingga dapat memperoleh haknya atas dana yang telah disepakati bersama. Belum ada ketentuan peraturan perundang-undangan di Indonesia yang mengatur bilyet giro secara khusus. Peraturan tersebut dibuat oleh Bank Indonesia. Meski peraturan telah dibuat sedemikian rupa, namun permasalahan bilyet giro kosong masih terjadi dikalangan masyarakat. Perlu penelitian untuk pengaturan yang lebih kuat lagi untuk meminimalisir terjadinya kasus bilyet giro kosong untuk memberikan rasa aman bagi masyarakat. With a checking account, people can make non-cash payments and become more efficient. Something that is easy, does not mean that it is free from problems. Bilyet giro in its use often encounter problems. In this case, the problem that occurs can be in the case of an empty bilyet giro. The legal consequences affect the debtor who defaults because of the issuance of a blank bilyet giro, and legal remedies can be pursued by creditors who are harmed by the existence of a blank bilyet giro. Legal consequences can apply if the perpetrator does not keep his promise and is imposed on the debtor. in order to fulfill its obligation to pay the nominal written in the bilyet giro. Also, legal remedies can be pursued by creditors who are harmed by default by the debtor, so that they can obtain their rights to funds that have been mutually agreed upon. There are no provisions of laws and regulations in Indonesia that specifically regulate bilyet giro. The regulation is made by Bank Indonesia. Although the regulations have been made in such a way, the problem of empty bilyet giro still occurs among the community. Research is needed for stronger regulations to minimize the occurrence of empty bilyet giro cases to provide a sense of security for the community.)
